Liability Waiver and Assumption of Risk
I acknowledge that I am voluntarily entering and participating in activities at Clover Run Farm, a working horse farm located in Kentucky. I understand that my visit may include, but is not limited to, horseback riding, handling or being around horses, horse boarding, stall or paddock rentals, RV camping, fifth-wheel or house rentals, golf cart use, and access to barns, pastures, trails, parking areas, and other farm property.
I understand and acknowledge that horses and farm environments involve inherent risks that cannot be eliminated. These risks include, but are not limited to, horses that may kick, bite, buck, rear, bolt, stumble, or otherwise behave unpredictably, uneven ground, mud, gravel, holes, fences, gates, farm equipment, tractors, utility vehicles, wildlife, insects, weather conditions, and other hazards commonly found on a working farm. I understand that these conditions may result in serious injury, illness, property damage, permanent disability, or death. I voluntarily assume all risks associated with entering or remaining on the property and participating in any activities at Clover Run Farm, whether such risks are known or unknown, obvious or not obvious.
To the fullest extent permitted by Kentucky law, I release, waive, and discharge Clover Run Farm and its owners, employees, agents, volunteers, and representatives from any and all claims or causes of action arising from my presence on the property or participation in activities, including claims resulting from ordinary negligence. This release does not apply to conduct that cannot legally be released under applicable law. I agree to follow all posted rules and any instructions provided by Clover Run Farm owners and staff. I understand that I am responsible for supervising any minor children accompanying me and for any damage to Clover Run property caused by me, members of my party, or my personal property.
Kentucky Equine Activity Warning
WARNING: Under Kentucky law, an equine activity sponsor, equine professional, veterinarian, farrier, or other person does not have the duty to eliminate all risks of injury associated with equine activities, and may not be liable for injury or death of a participant resulting from the inherent risks of equine activities pursuant to Kentucky law.
By signing below, I acknowledge that I have carefully read and understand this Liability Waiver and Assumption of Risk, understand that I am giving up certain legal rights, and voluntarily agree to its terms.
If the participant is under 18 years of age, the person signing must be the parent or legal guardian of the minor and consents to the minor's participation on behalf of both themselves and the minor.
